The Ibero-American Conference is a forum for dialogue, consultation and cooperation in which the observance of human rights is an essential principle. These rights are an area of action of the Ibero-American system. The instruments adopted by the Conference and other Ibero-American instances provide political and legal indications in the field of human rights that must be developed through initiatives, actions, programmes and agendas of cooperation. Social rights deserve special attention at the Ibero-American Summits. All this should have an influence (...) on the positions of the Inter-American Court of Human Rights, particularly when it deals with cases in which are affected economic, social and cultural rights, as it has been done in the wake of recent judgments on the matter. The work of the Ibero-American system in the fields of migration and culture will be of particular interest to the Inter-American Court in determining the content and scope of the rights recognized and protected in the inter-American system. RESUMEN: La labor del Tribunal Penal Internacional para la Ex-Yugoslavia tuvo un momento importante en la compresión del principio de legalidad, como principio básico en la garantía de los derechos humanos, al enfrentar no sólo el derecho consuetudinario como fuente de derecho sino también diferentes modos o enfoques en la identificación de este derecho consuetudinario. Esta relación debe ser analizada a la luz de las limitaciones que tiene el derecho internacional y, sobre todo, de los procedimientos de creación de normas. (...) No resulta fácil exigir responsabilidad en el cumplimiento del derecho internacional humanitario y de los derechos humanos. La práctica de este Tribunal abre una vía para la reflexión con la finalidad de asegurar el respeto de los derechos humanos en cualquier circunstancia, incluso de aquellos que llevaron a cabo la comisión de graves crímenes contra la comunidad internacional.ABSTRACT: The work of the International Criminal Tribunal for the former Yugoslavia was important for understanding the principle of legality as a key principle on the guarantee of Human Rights. The former was due to the Tribunal’s work on having faced the customary law as a source of law using different perspectives for its identification. The link between customary law, principle of legality and human rights has to be analyzed taking in account the limits of International law and the procedures for creating legal norms. It is not easy to invoke responsibility in the fulfillment of international humanitarian law and international law of human rights. The practice developed by this Tribunal provides an avenue for thinking about ensuring the respect of the human rights in any case including the commission of grave crimes against international community. This essay frames systemic patterns of mental abuse against women of color and Indigenous women on Turtle Island (North America) in terms of larger design-of-distribution strategies in settler colonial societies, as these societies use various forms of social power to distribute, reproduce, and automate social inequalities (including public health precarities and mortality disadvantages) that skew socio-economic gain continuously toward white settler populations and their descendants. It departs from traditional studies in gender-based violence research that frame mental abuses such as gaslighting--commonly (...) understood as mental manipulation through lying or deceit--stochastically, as chance-driven interpersonal phenomena. Building on structural analyses of knowledge in political epistemology (Dotson 2012, Berenstain 2016), political theory (Davis and Ernst 2017), and Indigenous social theory (Tuck and Yang 2012), I develop the notion of cultural gaslighting to refer to the social and historical infrastructural support mechanisms that disproportionately produce abusive mental ambients in settler colonial cultures in order to further the ends of cultural genocide and dispossession. I conclude by proposing a social epidemiological account of gaslighting that a) highlights the public health harms of abusive ambients for minority populations, b) illuminates the hidden rules of social structure in settler colonial societies, and c) amplifies the corresponding need for structural reparations. What role could have intrinsic motivation toward reading in an extraordinary situation like the recent confinement? This research examines the relationship between intrinsic reading motivation and reading habits in an adult population considering types of reading, gender, and distress generated by the coronavirus disease 2019 pandemic. Participants were 3,849 adults from Spain who were surveyed about their reading practices: before, during the first weeks, and after several weeks of confinement. Linear mixed effects models were used to analyze data. Results showed (...) a three-way interaction between reading frequency, IRM, and type of reading. Also, distress seems to pose a differential impact depending on the type of reading. The higher the IRM, the lesser the time devoted to study/work reading and the more to social and news reading. In this sense, IRM can function as a protective factor of reading behavior but only for leisure reading. Results support previous findings of the importance of consciously promoting this type of motivation in all individuals beyond educational contexts, since it seems to be positively related to well-being. In the wake of continued structural asymmetries between women of color and white feminisms, this essay revisits intersectional tensions in Catharine MacKinnon’s Toward a Feminist Theory of the State while exploring productive spaces of coalition. To explore such spaces, we reframe Toward a Feminist Theory of the State in terms of its epistemological project and highlight possible synchronicities with liberational features in women-of-color feminisms. This is done, in part, through an analysis of the philosophical role “method” plays in MacKinnon’s argument, (...) and by reframing her critique of juridical neutrality and objectivity as epistemic harms. In the second section, we sketch out a provisional coalitional theory of liberation that builds on MacKinnon’s feminist epistemological insights and aligns them with decolonizing projects in women-of-color feminisms, suggesting new directions and conceptual revisions that are on the way to coalition. This paper addresses the question as to whether the methodology followed in building/assessing string theory can be considered scientific in the same sense, say, that the methodology followed in building/assessing the Standard Model of particle physics is scientific, by focussing on the "founding" period of the theory. More precisely, its aim is to argue for a positive answer to the above question – there is no real change of scientific status in the way of proceeding and reasoning in fundamental physical (...) research – in the light of a historical analysis of the early developments of the string theoretical framework. In this paper I tackle Gadamer’s and Dewey’s conceptions of art, showing a possible dialogue between American Pragmatism and Gadamerian Hermeneutics. Despite the obvious differences, it is possible to show fundamental commonalities between the two philosophies when it comes to the role of art. They share the double goal of critiquing the aestheticism of modern age, the conception of art as a mere “art for art’s sake,” and of recomposing the continuity between aesthetic experience and everyday life. I argue that (...) this common goal entails a reassessment of the relation between the work of art and the public, a reassessment that has fundamental consequences for the role of art in our societies. The present comparison will also help shed new light on Gadamer’s conception, often accused of being a merely conversative theory. For both Gadamer and Dewey art does not consist in a product of the elites that is given to the spectators: rather, the spectators cooperate with the author in the creation and development of the work of art itself. We argue that dualities offer new possibilities for relating fundamentality, levels, and emergence. Namely, dualities often relate two theories whose hierarchies of levels are inverted relative to each other, and so allow for new fundamentality relations, as well as for epistemic emergence. We find that the direction of emergence typically found in these cases is opposite to the direction of emergence followed in the standard accounts. Namely, the standard emergence direction is that of decreasing fundamentality: there is emergence of less (...) fundamental, high-level entities, out of more fundamental, low-level entities. But in cases of duality, a more fundamental entity can emerge out of a less fundamental one. This possibility can be traced back to the existence of different classical limits in quantum field theories and string theories. (shrink)

For companies involved in the supply chain, proper warehousing management is crucial. Warehouse layout arrangement and operation play a critical role in a company’s ability to maintain and improve its competitiveness. Reducing costs and increasing efficiency are two of the most crucial warehousing goals. Deciding on the best warehouse layout is a remarkable optimization problem. This paper uses an optimization method to set bin allocations within an automated warehouse with particular characteristics. The warehouse’s initial layout and the automated platforms limit (...) the search and define the time required to move goods within the warehouse. With the help of historical data and the definition of the time needed to move goods, a mathematical model of warehouse operation was created. An optimization procedure based on the well-known Variable Neighbourhood Search algorithm is defined and applied to the problem. Experimental results demonstrate increments in the efficiency of warehousing operations. (shrink)

There is a growing trend across North America of women being criminalized for their pregnancy outcomes. Rather than being a series of aberrations resulting from institutional failures, we argue that this trend is part of a colonial strategy of administrative violence aimed at women of color and Native women across Turtle Island. We consider a range of medical and legal practices constituting gender-based administrative violence, and we argue that they are the result of non-accidental and systematic production of population-level harms (...) that cannot be disentangled from the goals of ongoing settler occupation and dispossession of Indigenous lands. While white feminist narratives of gender-based administrative violence in Latin America function to distance the places where such violence occurs from the ‘liberal democratic’ settler nation-states of the U.S. and Canada, we hold that administrative forms of reproductive violence against Latin American women are structurally connected to efforts in the U.S. and Canada to criminalize women of color and Indigenous women for their reproductive outcomes. The purpose of these systemically produced harms is to sustain cultures of gender-based violence in support of settler colonial configurations of power. (shrink)

This paper reports an experiment that investigates interpretive distinctions between two different expressions of generalization in Spanish. In particular, our aim was to find out when the distinction between generic statements (GS) such as Tigers have stripes and universally quantified statements (UQS) such as All tigers have stripes was acquired in Spanish-speaking children of two different age groups (4/5-year-olds and 8/9-year-olds), and then compare these results with those of adults. The starting point of this research was the semantic distinction between (...) GS and UQS in that the former admit exceptions, unlike the latter. On the other hand, several authors have observed a Generic overgeneralization effect (GOG) consisting in allowing for UQS to be felicitous in the face of exceptions, thus proposing that this “error” stems from GS being defaults (simpler, more easily learned and processed). In the current paper we aimed to test the “Generics as Default” (GaD) hypothesis by comparing GS and UQS in three different age ranges. Our data show that, overall, the accuracy of GS is greater than the accuracy of UQS. Moreover, we also confirm a hypothesized interaction between age and NP type (GS vs UQS). Further, we present several data points that are not predicted by the GaD, including an observed decline in the accuracy of GS in the older group of children as well as in adults, and that children fail at rejecting statements that are not considered to be true generalizations. Se leggiamo tra le righe del suo lavoro, possiamo scoprire che Varzi prende i mostri molto sul serio. Troviamo, per esempio, mostri mereologici frutto della composizione non ristretta, come l’entità costituita dalla metà sinistra di questa mela e dal bracciolo di quella poltrona.10 Oppure mostri topologici dai quali una teoria mereotopologica delle nicche deve rifuggire, come le curve riempispazio di Peano e Hilbert.11 O, ancora, mostri ontologici come l’antimateria;12 le entità “inesistenti” che, come si sa, non possono esistere, dato che (...) non ci sono cose che non esistono; e le entità “negative”: buchi, mancanze e omissioni, conferenze non date.13 In questo contributo, seguendo il suggerimento di Varzi, parlerò, appunto, di mostri, prendendo l’avvio da alcune creature che popolano il regno della finzione, per poi passare a trattare dei mostri che popolano il nostro mondo. Essendo poco lo spazio e molti i mostri, procederò dapprima proponendone una tassonomia – punto di partenza per ogni generalizzazione che si rispetti – e in seguito cercando di illustrare perché i mostri vadano presi sul serio in metafisica. È d’obbligo precisare che si tratterà di una tassonomia parziale e provvisoria, ma lo è altrettanto ricordare che le tassonomie, quelle biologiche in particolare, lo sono sempre, per due ragioni. In parte, perché la vita è in costante evoluzione, in parte perché le nostre conoscenze e decisioni condizionano la struttura e i contenuti dei nostri sistemi di categorie: basti pensare che la prima edizione del Systema naturae di Linneo contava undici pagine, mentre la tredicesima ben tremila, ripartite in sei volumi. Quando un tassonomo scopre un organismo che ritiene – dopo accurati esami comparativi – essere appartenente a una specie fino ad allora sconosciuta, ne deposita nella letteratura scientifica, insieme al nome binomiale (cioè il nome specifico, composto dall’indicazione del genere e della specie, come Homo sapiens), una descrizione in termini di caratteri fenetici. Quel token è chiamato tipo nomenclaturale, o esemplare-tipo, ed è il portatore del nome della specie di cui viene considerato tipo. Sulla falsariga della procedura appena descritta, riporterò la descrizione di alcuni tipi nomenclaturali per una tassonomia mostruosa che si baserà su tre criteri principali: (1) l’origine, (2) la costituzione genetica, (3) l’aspetto fenotipico. Prima di procedere, vorrei però sottolineare tre rispetti sotto i quali classificare mostri mitologici differisce dal classificare individui “ordinari”. Innanzitutto, nel caso dei mostri mitologici non è possibile, a causa del frequente intervento divino, ricorrere al criterio dell’interfecondità per stabilire se due mostri appartengono alla medesima specie. Ma d’altro canto, tale criterio, benché sia abbastanza affidabile per gli animali, non lo è affatto, per ragioni diverse dai mostri, per molte piante, alghe e funghi. Un’altra peculiarità da segnalare – di cui però non avremo modo di occuparci oltre – è che le entità mitologiche sono frequentemente soggette a trasformazioni sostanziali, mentre la nostra biologia sembra, aristotelicamente, escluderne la possibilità: una tigre non può trasformarsi in un canguro, pena la sua uscita dall’esistenza. Meno paradossalmente, una larva di mosca e la mosca adulta saranno considerate appartenenti alla medesima sorta – la mosca, appunto – benché dall’una all’altra non vi sia praticamente alcuna continuità materiale (nella metamorfosi la larva viene distrutta quasi completamente e l’adulto si genera a partire da pochi aggregati cellulari indifferenziati). Infine, nel caso dei mostri mitologici, parlerò più genericamente di “gruppo tassonomico” anziché di “specie” (e dunque il nome dei tipi nomenclaturali non sarà un nome binomiale) dal momento che, come diverrà chiaro nel corso della lettura, è proprio il concetto di “specie” come diverrà chiaro nel corso della lettura, è proprio il concetto di “specie” come articolazione naturale non oltrepassabile che i mostri che andiamo a classificare ci chiedono di mettere in discussione. Biological conservation has a long story, but what distinguishes Conservation Biology from previous conservation fields is its multidisciplinary scope and its character as a mission-oriented crisis discipline. These characteristics suggested the introduction of the metaphor of biological conservation as a sort of surgery. This paper is about the initial stages of such surgery. Firstly, some data about the so-called “Big Sixth”—the disease—will be presented together with some information about Conservation Biology—the surgeon. Then epistemic and epistemological difficulties in extinction assessment and (...) conservation prioritization, and triage in particular, will be pointed out. It will be argued that, while data deficiency arising from empirical and practical constraints can in principle be overcome, a different order of difficulties stems from the competition among several species concepts. In this case, it will be suggested that the extent of complications is of such significance to require a thorough re-assessment of the very nature of the patients, i.e., outside the metaphor, of the concept of species. Nel 2009, prendendo le mosse da articoli e libri pubblicati negli anni precedenti, Maurizio Ferraris proponeva la “documentalità”, una ontologia sociale che, a differenza della received view basata sull’intenzionalità collettiva, individuava il fondamento degli oggetti sociali negli atti iscritti. Prendendo come spunto due oggetti sociali tipicamente torinesi – il capoluogo piemontese è il luogo di nascita del filosofo – e cioè la casa automobilistica Fiat e l’Università di Torino, in questo breve saggio si discutono alcune tra le tesi che caratterizzano (...) una ontologia sociale siffatta. Particolare attenzione viene data alla tesi secondo cui l’identità di un oggetto sociale e la sua permanenza attraverso il tempo dipenderebbero dall’iscrizione che ne è alla base anziché, come per esempio nella posizione searliana, dall’oggetto fisico sottostante. Questa tesi, si sostiene, acquisisce particolare pregnanza nell’epoca del web, quell’acceleratore della documentalità, per dirla con le parole del filosofo, che ha la caratteristica di mostrare nella sua evidenza la struttura stessa della realtà sociale e, in tal modo, di diventare uno strumento per il cambiamento. Mettendo in luce la linea concettuale che unisce Documentalità (2009) con uno dei lavori più recenti di Ferraris, Mobilitazione totale (2015), si articola e si sostiene l’idea secondo cui il web svolge una duplice funzione. Da un lato, rivelare l’emergere della società dalla natura, riproducendo in tempi osservabili e in un ambiente monitorabile, quello di cui non è possibile essere spettatori diretti. Dall’altro, renderne evidente la struttura ultima che, appunto, è una struttura documentale. (shrink)

My contribution deals directly with the problem of Kant’s apparent commitment to pan- aestheticism, which is in particular attached to the task of explaining the possibility of the free play of the faculties. The aim is to provide an overview of the ways in which this problem can be confronted and eventually solved. In this regard, one way to deal with this problem consists in revisiting the assumption that the free play of the faculties is to be understood as simply (...) occurring without presupposing any concept. By contrast, one can fully endorse Kant’s commitment to pan- aestheticism and hence focus on how Kant’s account explains the fact that one does not actually experience everything as beautiful. Both of these alternatives, I firmly reject. By remarking upon the merely reflecting status of judgments of taste, I explain why Kant’s account of taste does not lend itself to pan-aestheticism. Normal development of the nervous system is achieved through an elaborate program of guided neuronal migration and axonal growth. In the last few years, a flood of research has dissected the molecular bases of these phenomena, and several cell‐surface and extracellular matrix molecules, which are implicated in neuronal and axonal targeting processes, have been recognized. Taking this knowledge a step further, a recent paper by Tom Curran's group(1) reports the molecular cloning of the gene deleted in the autosomal recessive mouse (...) mutation reeler, affecting cortical neuronal migration. Background: Cinematherapy and video treatments are artistic therapeutic techniques by which the individuals are exposed to their psycho-physical difficulties through the stories of the characters on the screen who are coping with the same issues that the patients are. Although these techniques are increasingly common within modern art therapies, there are neither comprehensive classifications of the different approaches nor agreement on their effectiveness. We performed a scoping review, describing different methodological approaches and outcome measures in cinematherapy and video treatments.Methodology: We (...) searched articles in PubMed, PsycINFO and Google Scholar. We included: articles in which subjects were treated for their difficulties with videos or films, articles written in English. Review articles and papers describing a research protocol without data collection were not included.Results: We analyzed 38 studies. Thirty-six reported a positive effect of the treatment. Seven studies used classical cinematherapy, adopting a qualitative approach to measure the therapy outcome. Thirty-one studies used different video treatments, 8 of which were defined as randomized controlled trials with specific objective therapy outcomes. Studies were mainly focused on behavioral and psychological difficulties in Autism Spectrum Disorders and Schizophrenia.Conclusion: Studies using video treatments more often rely upon structured experimental designs; on the contrary, those who used classical cinematherapy produced descriptive results. A more standardized methodological approach in terms of experimental design, procedure, and objective outcome measure is needed to provide evidence on the effectiveness of these techniques, promoting its application in the clinical field. Quentin Meillassoux defiende una posición llamada “materialismo especulativo”, la cual asegura haber alcanzado –por un procedimiento estrictamente racional– algo absoluto. Con este gesto afirma ir más allá de la crítica kantiana y del fideísmo. Esta postura es muy diferente de los materialismos tradicionales, pero también de todo tipo de absoluto metafísico, pues niega la validez del principio de razón suficiente y rechaza la existencia necesaria de cualquier entidad. Lo único necesario para Meillassoux es el principio que afirma que todo es (...) contingente, y la concomitante irrazón de todo lo que existe. El autor objeta que se pueda sostener racionalmente que lo real carece de inteligibilidad, a la vez que argumenta que se puede justificar la tesis del surgimiento ex nihilo de la vida, el pensamiento, e incluso de la divinidad, con el razonamiento de que la contingencia radical de todo implica también que todo es posible, excepto lo contradictorio.
